The Litigating AI

Big news this week from a company, AI.law that could shorten the investigation to filing process.

A press release from the company as reported by Fox2Now states its AI platform drafts a lawsuit from scratch. AI.law has been in the AI document space for a bit, focusing on document summarization, analyzation and generalization.

Using the “legal assistant” angle, the company explains that it takes user factual data and drafts a complaint. Put simply, users upload the facts and information to be included. Then, “[t]he final product of this module includes formatting, an introductory statement, general allegations, a jurisdictional allegation, counts with claim elements included, and a robust demand section.”

This Not Just a Doc Gen Tool

The platform doesn’t just analyze and organize case data to generate a document. It has a “claims identifier” feature.

By entering the details of your case into ai.law, the system efficiently proposes a range of potential legal claims under state and federal law. This bypasses the traditional, time-consuming method of manually researching previous cases for potential additional claims to bring.

But that’s not all. It includes a feature includes call,” Dismissal Analyzer,” which ” that “scans the lawsuit to identify elements of each claim and then suggests whether each is factually supported.” If the AI determines the claims are not well-supported, “ai.law’s Dismissal Analyzer indicates what facts might be added to avoid a motion to dismiss for failing to state a claim.” It works by identifying all the claims and their elements, analyzing the allegations, and then predicting potential failures. So it helps from A to Z. Now, caution to attorneys out there, do not just use this thing and file a lawsuit. See, e.g., New York lawyers sanctioned for using fake ChatGPT cases in legal brief | Reuters. Double-check your work; you’re signing the pleading. See, e.g., Fed. R. Civ. Pro. 11.

Not just for Plaintiffs’ Lawyers and Pleadings

It allows for responding to completes as well. It prepares answers to lawsuits. It also has applications for discovery. Specifically, it has a discovery response module. It includes a library of objections. It also summarizes records to find information and data in dense volumes, including medical records. See 10 Great Features of ai.law – ai.law at 1.

Sounds like another great tool that might combine elements of other free-standing solutions out there.
